TERMS AND CONDITIONS

• This agreement governs your use of the TMAKER site and services. This includes all orders for products or services and the user forums. Consequently, you and TMaker Sales Sdn. Bhd., a Delaware corporation (TMAKER), are the formal parties to this agreement.
• TMAKER reserves the right to change these terms from time to time. If we update the terms, we will ask you to accept them to continue using our services. However, if you disagree with any amendments, you must stop using the site immediately.

• TMAKER owns all intellectual property on this site, excluding user content. Specifically, we grant you a limited, revocable license to use our site for its intended purpose: the provision of an online, on-demand, customizable merchandising solution.
• To protect our community, you must not:
  (a) Disrupt our software using viruses or harmful technology;
  (b) Do not modify, copy, or reverse engineer any technology on the site;
  (c) Use a robot or automated means to monitor activity or copy pages;
  (d) Impersonate another person or entity;
  (e) Do not promote hate speech or obscenity that violates our Ethical Guidelines.
  

• You can shop through our online store or create designs using our online software. Therefore, all merchandise remains our property until you fulfill the payment. For this reason, we report all fraud attempts to the police.
• TMAKER reserves the right to cancel or investigate suspicious orders. While we strive for accuracy, minor deviations in material, color, weight, and measurements may occur.

• Prices exclude the 6% Goods and Services Tax (GST). Specifically, we apply GST to deliveries within Malaysia, except for Langkawi, Labuan, and Pulau Tioman.
• When you place an order, you make a binding offer for a contract of sale. Consequently, we will send an order confirmation email. Note that this email acknowledges receipt but is not an acceptance of the offer.

• We only accept the offer once we confirm that production is complete in a second email. However, TMAKER does not guarantee the continued availability of any product or design.
• Since technical data in catalogues is purely informational, the order confirmation email controls any inconsistencies. Our service is complete once the shipment provider completes delivery to your address.

• TMAKER warrants that it will ship orders within three weeks. Generally, goods ship within a few days, and typical delivery takes 2-4 days. However, you may separately agree to express shipping terms in writing.
• You must pay standard shipping costs, which depend on order value and destination. If an interruption occurs and we cannot replace the order in a reasonable time, we will notify you immediately.

• Your order may be subject to import duties and taxes once a shipment reaches your country. Since we do not control these charges, we are not responsible for them. Thus, you are responsible for all customs clearance charges.

• You can pay via Direct Bank Transfer, PayPal, or Online Banking. TMAKER may limit payment methods based on objective criteria. If you provide payment information that makes a transaction impossible, we may add a charge to recoup our processing costs.
• If a customer fails to pay, we may assign claims to a debt collection agency and transfer necessary data to these third parties.

• TMAKER owns the goods until we receive full payment. Therefore, title and risk of loss pass to the customer upon transfer to the carrier.
• Our Return Policy:
  (a) Contact us within 7 days of receipt if you are dissatisfied;
  (b) We do not accept returns on personalized items with custom artwork;
  (c) Items cannot be returned if worn, soiled, or washed incorrectly;
  (d) We offer refunds if an item is out of stock or not received within 30 days.
  

• If you upload designs, you warrant that you own all necessary rights, such as trademarks or copyrights. Hence, you release TMAKER from any liability relating to intellectual property infringement.
• TMAKER has no responsibility for damages suffered in connection with the site. Use of our services and software is at your sole risk.

• We encrypt and secure all credit card information through iPay88. TMAKER only uses your personal information to fulfill our undertakings. We will not sell your data to third parties without your prior consent.
• You have the right to see, correct, or delete your personal details upon request. To end your subscription, please email tmakersales@gmail.com.

• These Terms and all disputes shall be governed by Swedish law. Additionally, TMAKER may refuse to provide services immediately if we believe you have violated these terms. If we terminate access, this agreement survives indefinitely.
